Clarence Thomas: Supreme Court should strike down same-sex marriage and contraceptive rights next

Judge Clarence Thomas on Friday upheld some of the darkest warnings about the fall of the US Supreme Court Roe v. Calf.

The Conservative-dominated court overturned the landmark decision that enshrined a woman’s right to an abortion, saying individual states can allow or restrict the procedure themselves.

“The Constitution does not grant a right to abortion; roe and Casey are overridden; and authority to regulate abortion will be returned to the people and their elected representatives,” the court said.

The right-wing court was expected to overturn the verdict after a draft circulated showing that Judge Samuel Alito had penned a shattering decision roe in the event of Dobbs v. Jackson Women’s Health Organizationand many warned the court would next target other agreed rights.

Thomas opened the door to that in a unanimous opinion on the 6-3 ruling in Dobbsand said the court should reconsider decisions protecting the right to contraception, same-sex relationships and same-sex marriage.

“In future cases, we should consider all of this court’s significant due process precedents, including Griswold, Lawrence and Obergefell,” Thomas wrote. “Because every substantive due process decision is ‘provenly wrong’ … we have a duty to correct ‘the error’ found in those precedents … After the repeal of these provably wrong decisions, the question would remain as to whether other constitutional provisions the countless guaranteed rights that our significant due process cases have generated.”

Democrats blasted Thomas for his opinion.

“If you think the Dobbs decision doesn’t affect you, think again. Judge Thomas says the soft part out loud: He thinks the court should remove protections for contraception, sexual intimacy and marital equality. This radical court cannot be trusted to protect your rights,” said Rep. Jerry Nadler (D-NY) in a message posted on Twitter.

“This is the first time in our nation’s history that the Supreme Court has ruled to overturn a right it had previously protected. As Judge Thomas notes in his concurring opinion, other rights may follow,” said Rep. Bonnie Watson Coleman (D-NY ) wrote on twitter.
